Evaluation
Evaluation is carried out by performing case specific impact assessments. These impact assessments build the foundation of our evidence-based regulatory proposals. Norms design an ideal word. But what is the impact of visions, policies and regulations in the real world? Evaluating the effects of regulatory policies is crucial in order to adopt new normative ideas and improve the normative order.
« The principle that a legal order, as a whole, must be […] effective in order to be valid is itself a norm. »

Independent and scientific evaluations built the basis for better regulation. They examine whether regulations are achieving their objectives and operating as expected. Especially the EU and the OECD have developed Guidelines and Toolboxes for better regulation and impact assessments.
EU
The better regulation agenda helps the EU deliver evidence-based policies and laws that achieve their objectives in the most efficient way, while being tailormade to the needs of EU citizens, businesses, and civil society. The better regulation guidelines set out the principles that the European Commission follows when preparing new initiatives and proposals and when managing and evaluating existing legislation.

OECD
The OECD reviews regulatory reforms, reports on the Better Regulation Practices across the European Union and issues Best Practice Principles for Regulatory Policy on Regulatory Impact Assessment.

National and international norms entail duties to evaluate policies and perform regulatory impact assessments. Especially in the field of new technologies and the protection of the environment duties to perform impact assessments become more and more relevant.
